Stores and other businesses frequently videotape their surroundings. However, after a specific amount of time, the recordings are frequently destroyed. 

As a result, sending an evidence preservation letter might be beneficial in informing them of an occurrence and ensuring that the films or other recordings are not deleted. 

This letter will not ensure that evidence is preserved, but it may be useful in demonstrating that businesses deleted evidence on purpose.

Sample Evidence Preservation Letter

To Whom It May Concern:

This letter is a formal demand that you preserve any and all evidence related to the incident that happened at [LOCATION] on [DATE] at around [TIME].

Your company is hereby required to maintain AND preserve any and all ORIGINALS AND COPIES OF videos (including security and surveillance videos) and photographs of the inside, outside, and entrance ways of the subject location for the 24-hour period preceding and following the above-described incident. 

Please forward copies of these videos and photographs to my attention as soon as possible. Please keep in mind that any item(s) associated with the incident/claim mentioned above must be preserved.

Failure to do so can result in consequences in any litigation or action, including an order banning the inclusion of any such evidence.

Finally, please contact our office as soon as possible with your liability insurance carrier's contact information. Meanwhile, if you haven't already done so, please contact your insurance carrier about the occurrence. 

Please contact me as soon as possible, but no later than ten days after you get this letter. We won't need to contact you again as a result of this.
